In Australia, just as in the U.S., there is a serious problem with drunk driving.  “Down Under,” they have a governmental agency called TAC that polices the highways and also provides medical attention to car accident victims. This agency also launches many public safety campaigns to promote safe driving and prevent car accidents.

Sam Foltz was a punter on University of Nebraska’s Cornhusker’s football team.  He was the best punter of that team and was also named as the best punter in the Big Ten Athletic Conference of the National Collegiate Athletic Association (NCAA).  Sadly, his blossoming career was cut short as he was was returning to campus to complete his senior year. He was killed in fatal car accident at the age of 22, according to a recent news article from the Lincoln Journal Star.

mQo4CWyAuthorities say Foltz was a passenger in the car traveling back to campus a few minutes before midnight when the deadly accident occurred.  They believe the driver of the vehicle lost control and crashed into a tree that was planted in the sidewalk alongside the road on which they were traveling. By now, most people have heard about Pokemon Go.  This smartphone app which just became available for download recently allows users to walk around the real world while hold their phones and looking for game characters.

iphone6Not only has the new app already become hugely popular, it has resulted in more than a few serious problems.  News of the problems first broke when when a pair of alleged robbers managed to use the game to get players in a remote area and rob them.  They were later apprehended, but users were warned to be careful. However, in cases where one or more of the drivers involved were on-the-job at the time of the crash, matters of compensation may become slightly more complicated. Those injured may be entitled to workers’ compensation benefits if they were the ones working. In some cases, employers may be vicariously liable for the bodily injury and property damage caused by the negligence of working employees, owing to the legal doctrine of respondeat superior, or “let the master answer.”

A recent appellate court case out of Indiana, the court was considering whether a company should be liable for injury caused when an employee in the company parking lot transporting his personal recycling in his own vehicle struck a private security contractor. The Pokemon Go craze that swept the country resulted in all sorts of bizarre stories about video gamers trolling lawns late at night trying to “catch” the cartoon creatures. But there was on recent report that piqued the interest of our Boston car accident lawyers: That of a 26-year-old man who caused a major accident in Massachusetts after stopping in the middle of the highway to nab a Pikachu. iphone

According to The Boston Globe, insurance companies pin responsibility on falling gas prices and a steadily climbing economy. In turn, officials say, there has been an uptick in Boston car accidents and collisions overall throughout Massachusetts. There was also a record snowfall last year, which also contributed to a large number of accidents.

Of course, the risk with higher auto insurance rates is that not as many people will be able to afford it. Some may opt for bare bones coverage, while others may drop their coverage altogether. According to a recent news report from WWLP, a man died in a single car crash in Blandford, Massachusetts on the Mass Pike. Another woman was seriously injured as a result of the crash.  The man was a passenger in the car involved in what turned out to be a deadly Massachusetts car accident.

Science fiction of the 1980s predicted a future with flying cars that could drive themselves. Here we are today – in that future – and flying cars aren’t a reality. However, self-driving cars of one sort or another are here – and probably not going anywhere.  The two main companies working on a self-driving car at this time seem to be Tesla and Google.

driveinGoogle’s self-driving car is supposed to be truly autonomous, in that a user can enter a destination and sit back and relax.  This system involves the use of around a dozen sensor devices including LIDAR units, and the company has said that it will be a few years before the product is ready for consumers.  Continue reading

According to a recent news feature from the Boston Herald, an SUV full of teens crashed into a utility pole in a suburban neighborhood and then slammed into a parked vehicle. The van was full of six teens who had just all just left work at a local ice cream shop and were headed to watch the fireworks show.

The mother and a neighbor heard what they described as the loudest screams imaginable.  When they got to the scene of the fatal Milford car accident, they saw that five of the occupants were standing outside of the vehicle looking at the victim who had been thrown from the vehicle during the crash. Regarding those under 21, the Massachusetts law regarding alcohol consumption is clear: Don’t. Further, if you host a party at which underage drinking is occurring, you need to be aware that you’re opening yourself up to potential liability, particularly if one of those underage guests takes off in a car.drunkdrinking

First of all, M.G.L. Chapter 138, Section 34 makes it a criminal offense to furnish alcoholic drinks to someone under 21, and punishes violators with up to 1 year in jail and/ or a $2,000 fine. Beyond that, you could be held liable to pay damages to the minor or any third parties who are injured as a result of minors consuming alcohol you provided or allowed to be consumed.

A recent case out of Maryland, where similar laws exist, was pursued after an under-21 drinker left a party and caused a car accident, killing one and seriously injuring another. That case, Kiriakos v. Phillips, resulted in the Maryland Court of Appeals (the highest court in that state) issuing a determination that adults who allow underage drinking on their property may owe a civil duty to injured persons – including the minor who was drinking – and that defendants in this case owed both victims a duty of care. That was a reversal of the trial court’s ruling. Continue reading
